The Hearings and Appeals Process

Should a dispute or question arise in regard to a Bronx workers' compensation claim, the Board may hold one or more hearings before a Workers' Compensation Law Judge. The Judge will preside over this hearing, review medical information and other evidence at hand and make a determination of whether the claimant is entitled to benefits. The Judge will also determine the amount and duration of benefits to be awarded. Should either side (the claimant or workers' compensation insurer/employer) be dissatisfied with the outcome of the hearing, they may file an appeal within 30 days of the Judge's decision.

An appeal is filed by applying in writing to the Board for a review. If the application for an appeal is approved, a Board Panel consisting of three members will review the case and may support, modify or overturn the Judge's decision. The Board Panel may also return the case to the Judge for further review. Should either party still be dissatisfied after an initial appeal, an appeal of the Board Panel may be taken to the Appellate Division, Third Department, Supreme Court of New York within 30 days. The Appellate Division's decision may be further appealed to the Court of Appeals.
